1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of Orion Pay’s website, platform, and services (“Services”). By using our Services, you agree to these Terms. If you do not agree, you must stop using our Services immediately.

Orion Pay is operated in Canada and registered as a Money Services Business (MSB) with FINTRAC.

 

2. Eligibility

You must:

• Be at least 18 years old (or the age of majority in your jurisdiction)
• Be legally capable of entering into contracts
• Not be located in a country where our Services are prohibited
• Provide accurate, complete, and current information during registration

 

3. Regulatory Compliance

You agree to comply with all applicable laws, including Anti-Money Laundering (AML) and Know Your Customer (KYC) requirements. Orion Pay may request identity documents, proof of address, and other verification materials before allowing transactions.

We reserve the right to refuse service, freeze accounts, or report activity if we suspect fraud, money laundering, terrorist financing, or other illegal activities.

 

4. Account Registration & Security

• You are responsible for keeping your account credentials secure.
• You must notify us immediately if you suspect unauthorized account access.
• You are solely responsible for all activity conducted under your account.

 

5. Services Provided

Orion Pay enables you to buy, sell, and trade supported cryptocurrencies using approved payment methods. We:

• Do not provide financial or investment advice
• Do not guarantee cryptocurrency value or performance
• Operate as a non-custodial platform, meaning crypto is sent directly to your wallet and not stored on our servers

 

6. Payment Methods

We accept:

• Wire Transfers
• Electronic Funds Transfers (EFT)
• Manual EFT Transfers
• Credit Card Payments

Transaction limits, processing times, and fees may vary. We reserve the right to update supported payment methods at any time.

 

7. Fees

All applicable fees are displayed before you confirm a transaction. By proceeding, you agree to these fees. Fees are non-refundable except where required by law.

 

8. Risks

You acknowledge that:

• Cryptocurrency prices are volatile and may lose value
• Transactions cannot be reversed once completed
• You are responsible for safeguarding your wallet addresses and private keys

Orion Pay is not responsible for losses due to market changes, incorrect wallet addresses, or your failure to secure your digital assets.

 

9. Prohibited Activities

You may not use our Services for:

• Illegal transactions or activities
• Fraudulent schemes or misrepresentation
• Funding terrorism or other criminal acts
• Violating sanctions or trade restrictions
• Attempting to bypass our security or verification processes

 

10. Intellectual Property

All content on the Orion Pay website, including logos, designs, and text, is our property and protected by copyright and trademark laws. You may not reproduce, copy, or modify our content without written permission.

 

11. Limitation of Liability

To the fullest extent permitted by law, Orion Pay shall not be liable for:

• Loss of profits, revenue, or data
• Indirect, incidental, or consequential damages
• Any loss due to unauthorized account access or third-party actions

 

12. Indemnification

You agree to indemnify and hold Orion Pay, its affiliates, employees, and partners harmless from any claims, damages, or expenses arising from your use of our Services, your violation of these Terms, or your breach of applicable laws.

 

13. Account Suspension & Termination

We may suspend or terminate your account without notice if you:

• Provide false or misleading information
• Engage in prohibited activities
• Fail to comply with these Terms

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of Canada. Any disputes will be resolved in the courts of Ontario, unless otherwise required by applicable law.
